E-SIGN STATEMENT

Before you can electronically enroll into The Private Bank of California’s online banking services ("Services"), you must read and indicate your acknowledgement and acceptance of this Statement. This Statement asks for your consent so that we can provide communications and information to you in electronic form ("electronic records") rather than in paper form.

If you do not provide your affirmative consent by clicking the “I Agree” button at the bottom of this Statement, then you will not be allowed to enroll into the Services electronically. Instead, you will be required to enroll in person at The Private Bank of California (“Bank”), 10100 Santa Monica Boulevard, Suite 2500, Los Angeles, California 90067.

  1. If you provide the Bank with your consent, then you agree that the Bank may deliver to you the following electronic records: (i) The Private Bank of California Online Banking Agreement and Disclosure, which contains consumer disclosures under the Electronic Fund Transfers Act and its implementing Regulation E; (ii) The Private Bank of California Online Bill Payment Disclosure and Agreement, which contains consumer disclosures under the Electronic Fund Transfers Act and its implementing Regulation E; (iii) monthly deposit account periodic statements; and (iv) notices regarding changes to The Private Bank of California Online Banking Agreement and Disclosure, The Private Bank of California Online Bill Payment Disclosure and Agreement, the Services and the Bank’s online banking system.

    If the Bank provides you with your monthly deposit account periodic statements and notices in electronic form rather than in paper form or in both electronic form and paper form, these electronic records will be stored for you to pick-up at the Bank’s website www.tpboc.com. If this service is initiated, the Bank will send you an e-mail when your monthly deposit account periodic statement is first posted to the Bank’s website or when a notice is first posted to the Bank’s website, letting you know that either one is now available to you for pick-up. The monthly deposit account periodic statements and notices will be stored in the confidential section of the Bank’s website and they will be available to you for at least 90 days following the date the monthly deposit account periodic statement or notice is first posted for pick-up or the date the Bank sends the e-mail to you, whichever is later. To access your monthly deposit account periodic statements or the notices, you will need to use the security procedures used as part of the Bank’s online banking system.

    In addition to the above, you agree and acknowledge that the Bank reserves the right to provide the above described electronic records to you by non-electronic means.

  2. Paper copies of the electronic records described in Section (1) above will be made available to you only if you specifically request a copy. You can request a copy of an electronic record by contacting the Bank at 310.286.0710.

  3. After you have consented to this Statement, you may withdraw your consent to receive electronic records at any time by contacting the Bank at 310.286.0710. However, if you withdraw your consent to receive electronic records then your use of the Services will be terminated and you will no longer be able to use the Services unless you appear in person at the Bank.

  4. Use of the Services requires the Bank to maintain your current e-mail address. You agree to provide the Bank with any updated information needed in order for the Bank to be able to provide you with electronic records from time to time and at any time. This includes, but is not limited to, providing the Bank with any changes to your e-mail address by contacting the Bank at 310.286.0710.

  5. In order to be able to access the Services and retain any electronic records provided to you by the Bank, as described in this Statement and in The Private Bank of California Online Banking Agreement and Disclosure and in the Private Bank of California Online Bill Payment Agreement and Disclosure, you must meet the following hardware and software requirements. To access your account(s) via the Internet, you must have internet access via a secure internet service provider and an internet browser that supports 128-bit encryption. The Bank’s online banking system is best viewed using Microsoft Internet Explorer Version 6.0 or later. If you use a MAC, we recommend using Microsoft Internet Explorer Version 6.0 or later. Your internet service provider can help you obtain the correct version.

  6. If the Bank changes the minimum hardware or software requirements needed to access or retain electronic records, and the changes creates a material risk that you will not be able to access or retain a subsequent record, then the Bank will let you know about the change(s) before the change(s) takes effect and let you know what the new requirements are.

    The Bank will notify you by e-mail, and at that time you will be allowed to choose whether you still want to give the Bank your consent to receiving communications or information by electronic means. If not, you will be allowed to withdraw your consent at that time, without any fee or charge. However, if you withdraw your consent, you may not be able to access the Services and your use of the Services will be terminated.
